Waiver and Release of Liability

I, the undersigned participant, acknowledge and agree to the following terms and conditions as a prerequisite for participating in any group workout, fitness class, or related activity at Forged In Fire Fitness Kalamazoo

1. Assumption of Risk: I understand that participating in fitness activities involves inherent risks, including but not limited to physical injury, heart attack, muscle strains, sprains, and other potential health risks. I voluntarily choose to participate, fully aware of these risks.
2. Health and Medical Clearance: I confirm that I am in good health and physically able to participate in the activities offered by Forged In Fire Fitness Kalamazoo. I have sought medical advice, or I have elected to participate without such advice, and I assume all responsibility for my participation.
3. Release of Liability: In consideration of being permitted to participate in the activities, I, on behalf of myself, my heirs, personal representatives, and assigns, hereby release and discharge Forged In Fire Fitness Kalamazoo, its owners, instructors, employees, and agents from any and all claims, demands, actions, or causes of action, arising out of or connected with my participation in these activities, including but not limited to any claims arising from negligence.
4. Indemnification: I agree to indemnify and hold harmless Forged In Fire Fitness Kalamazoo, its owners, instructors, employees, and agents from any and all claims, actions, suits, costs, expenses, damages, and liabilities, including attorney's fees, arising out of or related to my participation in any activities at the gym.
5. Personal Property: I acknowledge that Forged In Fire Fitness Kalamazoo is not responsible for any loss or damage to personal property brought to or left at the gym premises.
6. Rules and Regulations: I agree to abide by all rules and regulations set forth by Forged In Fire Fitness Kalamazoo. I understand that failure to follow these rules may result in the termination of my participation without refund.
7. Photography and Video Release: I consent to the use of my image, likeness, and voice in photographs, videos, and other recordings taken during the activities for promotional, advertising, and marketing purposes by Forged In Fire Fitness Kalamazoo, without compensation.
8. Severability: If any portion of this waiver is deemed invalid or unenforceable, the remaining portions shall remain in full force and effect.

By signing below, I acknowledge that I have read, understood, and agree to the terms and conditions of this waiver and release of liability. I understand that this is a legally binding document and that I am waiving certain rights by signing it.

Cancellation Policy

Monthly Memberships:

• Notice Period: Members may cancel their monthly membership at any time with a 30-day written notice.

• Refunds: No refunds will be issued for the remaining days within the 30-day notice period.

Annual Memberships:

• Early Termination: Members wishing to cancel an annual membership before the end of the term will be subject to an early termination fee equivalent to one month’s membership dues.

• Notice Period: A 30-day written notice is required for early termination.

 • At the end of your membership term, your membership will automatically renew unless you submit a cancellation request prior to your renewal date.

Medical and Relocation Exceptions

• Medical Conditions: Members can cancel their membership without penalty by providing a doctor’s note detailing a medical condition that prevents them from participating in fitness activities.

• Relocation: Members relocating more than 25 miles away from the gym may cancel their membership without penalty with proof of new address and a 30-day notice.

Suspension Policy

• Temporary Holds: Members can temporarily suspend their membership for medical reasons, travel, or other personal reasons with prior written notice. Suspensions are allowed for a minimum of 1 month and a maximum of 3 months per year.

Procedure for Cancellations and Suspensions

• Written Notice: All cancellation and suspension requests must be submitted in writing via email to ForgedinFireKzoo24@gmail.com or at the front desk.

• Confirmation: The gym will acknowledge receipt of the cancellation or suspension request within 7 business days. The effective date will be from the date of acknowledgment.

Refund Process

• Processing Time: Refunds, if applicable, will be processed within 14 business days from the date of cancellation confirmation.

• Method of Refund: Refunds will be issued via the original payment method used for the membership.

Changes to Policy

• Notification: The gym reserves the right to modify this cancellation policy. Members will be notified of any significant changes at least 30 days in advance.
